Section 61
Provisions regarding Tender Ballot

(1) If it appears from the evidence submitted by someone that someone has already taken a ballot paper or voted in the name of another voter and the person coming to vote later is the real voter, the polling officer shall give tender ballot paper to such voter. After the voter has indicated his/her vote on the tender ballot in this manner, such ballot shall not be placed in the ballot box but shall be kept in a separate envelope kept for that purpose.
(2) In accordance with sub-section (1), giving and holding tender ballot papers and other related procedures shall be as prescribed.
(3) During the counting of votes in accordance with this Act, tender ballots kept in separate envelopes as per sub-section (1) shall not be counted at that time. The court may also count such tender ballots if it is deemed necessary to decide the complaint related to the election.
